An integral and inseparable part of the OURL core specification and the associated licensing terms.

Scope of Application

This Charter applies to all implementations, derivatives, and uses — commercial and non-commercial — of OURL and Octology-related frameworks.

ARTICLE 1 — LEGAL BASIS AND LICENSING OBLIGATION

1.1 Any use of OURL — including parsing, interpretation, implementation, simulation, or derivative works — requires a written and explicit licence granted under the auspices of Octology.

1.2 This Ethical Charter constitutes a binding and enforceable condition of every OURL licence.
Violation of this Charter results in the immediate and automatic revocation of all usage rights, without prejudice to further liability under Belgian, European, and international intellectual property law.

1.3 Use of OURL without a valid licence, or use in violation of this Charter, shall be deemed an infringement of Octology intellectual property rights and will be subject to legal action without prior notice.

ARTICLE 2 — PRIMARY PURPOSE AND HUMAN-CENTRIC BOUNDARIES

2.1 OURL is a formal language designed to model, describe, and understand dynamic systems through resonance, interaction, friction, and context.

2.2 The exclusively authorised purposes are:

  • scientific research and exploratory analysis,

  • education and conceptual development,

  • diagnostic and analytical support under explicit human supervision,

  • design of systems that strengthen human autonomy, understanding, and responsibility.

2.3 The following purposes are explicitly prohibited and non-licensable:

  • exploitation of cognitive, emotional, or behavioural vulnerabilities,

  • creation of asymmetric advantage to the detriment of individuals, groups, or communities,

  • optimisation of profit, efficiency, or control at the expense of human well-being,

  • replacement of human judgement by automatic or autonomous decision-making.

ARTICLE 3 — EXCLUDED APPLICATION DOMAINS (NON-LICENSABLE)

Licences for the domains listed below are categorically refused.
Any implementation — including reverse engineering or indirect use — constitutes a direct infringement of Octology IP rights.

Excluded domains (non-exhaustive)

Gambling and wagering
Sports betting, casino systems, lottery optimisation, live odds manipulation, gambling systems for horse racing.

Extractive and speculative finance
High-frequency trading, algorithmic market manipulation, zero-sum speculation, emotionally triggered trading.

Extractive fisheries and marine exploitation
Industrial overfishing, bycatch optimisation at the expense of biodiversity, treatment of marine ecosystems as purely economic resources without ecological equilibrium analysis, applications aimed at maximum yield without preservation of system resonance.

Addiction mechanisms
Optimisation of gambling, screen, or purchasing addiction; dark patterns aimed at loss of self-control.

Social and political manipulation
Micro-targeting for political influence, emotional profiling without informed consent.

Autonomous weapon systems
Targeting, threshold decisions, or actuators without continuous, meaningful human supervision.

Note
Research into these domains solely for the purpose of knowledge acquisition, detection, or protection may be permitted under a strict academic licence, provided it is auditable and involves no operational deployment.

ARTICLE 3.1 — MEDICAL USE: EXCLUSIVELY UNDER RECOGNISED PROFESSIONAL FRAMEWORK

3.1.1 Use of OURL in the medical sector — including diagnostics (Claim 3), therapeutic design (Claim 4), and clinical decision support — is permitted exclusively under the following conditions:

a) use occurs within a recognised medical or clinical framework (hospital, diagnostic laboratory, registered research institution with ethical approval);
b) interpretation and decision-making rest with qualified healthcare professionals holding recognised professional titles and licences;
c) OURL functions solely as a supportive analytical instrument within a human decision-making loop — not as an autonomous diagnostic or therapeutic authority.

3.1.2 The following applications are categorically excluded and non-licensable:

  • direct-to-consumer (DTC) health applications using OURL for self-diagnosis without medical supervision;

  • commercial wellness platforms presenting OURL clusters as medical statements without professional mediation;

  • AI chatbots or digital assistants translating OURL output into medical advice for end users without a human physician or clinical geneticist in the loop.

3.1.3 Violation of this article constitutes a breach of this Ethical Charter and results in immediate licence revocation in accordance with Article 1.2.

ARTICLE 4 — OURL BAROMETRIC MODE (NORMATIVE AND TECHNICAL DEFINITION)

4.1 Definition
The OURL Barometric Mode is the only permitted mode for applications in contexts of government, oversight, compliance, integrity, and audit.

OURL measures tensions and deviations within a system;
judgement, decision-making, and responsibility remain exclusively with humans.

4.2 Operational restrictions (technically enforceable)
In Barometric Mode, OURL output may not:

  • be linked to automatic sanctions, actions, or threshold triggers;

  • result in ranking, scoring, or prescriptive recommendations without human interpretation;

  • be translated into binary or binding decisions without human intervention.

4.3 Audit requirements
Each implementation in Barometric Mode must generate auditable log files demonstrating that:

  • every subsequent action required human approval;

  • no automatic actuator was triggered solely by OURL output.

These logs must be retained for a minimum of seven (7) years and made available to Octology upon request.

ARTICLE 5 — RESPONSIBILITY AND LIABILITY

5.1 The licence holder bears full responsibility for:

  • compliance with this Charter,

  • legal conformity (including the EU AI Act and GDPR),

  • ethical application within the authorised purposes.

5.2 Octology and the rights holders:

  • accept no liability for damage resulting from unauthorised or Charter-violating use,

  • formally disclaim any application outside this framework,

  • reserve the right to unilaterally revoke licences upon reasonable indications of misuse.

ARTICLE 6 — COMPLIANCE WITH THE EUROPEAN AI ACT

6.1 OURL falls under Article 2(5) of the AI Act (research exemption) only insofar as:

  • use occurs within a controlled R&I environment,

  • no operational decisions are made without human supervision,

  • Barometric Mode is strictly adhered to.

6.2 When deployed in high-risk contexts (including medical diagnostics pursuant to Claim 3, judicial oversight, critical infrastructure):

  • a separate commercial licence is required,

  • a conformity assessment is mandatory,

  • demonstrable compliance with AI Act Annex III must be established.

6.3 Use in prohibited contexts (such as social scoring or real-time biometric identification in public spaces) is categorically refused.

ARTICLE 7 — OVERSIGHT AND ENFORCEMENT

7.1 Octology reserves the right to:

  • conduct unannounced audits,

  • activate contractually предусмотрed technical measures (including kill switches),

  • inform relevant third parties in cases of established systemic infringement.

7.2 Upon determination of infringement:

  • the licence is immediately revoked,

  • all derivatives are deemed infringing,

  • civil and criminal proceedings are initiated without further notice.

FINAL PROVISION

OURL is a language of resonance, not dominance.
It exists to help humans understand complexity, not to exploit uncertainty or consolidate power.

Any application outside this framework constitutes not only an ethical violation but also a legally enforceable infringement of the intellectual property rights of the Octology structure.

This Charter is irrevocably bound to the OURL specification.
Modification or detachment renders any implementation unlawful.
